Website Use

The website provides information about our hardscape services and a way to request an estimate. Use it lawfully, provide accurate information when contacting us, and avoid activity that interferes with its operation. You may not attempt unauthorized access to the private dashboard, introduce harmful code, submit spam, or misuse another person’s information.

Estimate Requests and Project Agreements

Submitting an estimate request starts a conversation about your project. It does not create a construction contract, confirm availability, reserve an installation date, or guarantee a price. We will follow up using the contact information you provide.

Website descriptions, photographs, and scheduling information are general information. Project scope, materials, pricing, payment schedules, warranties, and installation dates are established in a separate proposal or signed project agreement. These website Terms do not replace or change that agreement or any rights under applicable law.

Payment Options

Online deposits and invoices are paid through Stripe using ACH bank payments only.

We do not collect credit-card surcharges. ACH processing may require bank verification, and payments may take several business days to clear. This policy does not change the construction price or payment schedule in your signed project agreement.

Intellectual Property

Our original website content, branding, features, and design belong to Benchmark Hardscapes or its licensors. Third-party materials remain the property of their respective owners. You may view the website for personal use and evaluating our services. Reproducing, distributing, or commercially using protected content requires permission from the applicable rights holder, except where permitted by law.

We may link to third-party websites or services that we do not own or control. A link does not establish our endorsement. We are not responsible for their content, availability, privacy practices, or services. Review their terms and privacy policies before using them.

Suspension or Termination of Access

If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms govern website use; separate project agreements govern construction services.

SMS Terms & Conditions

The Benchmark Hardscapes owner receives automated internal SMS alerts through the private owner dashboard when a visitor submits an estimate request on the public website. Website visitors do not receive these alerts.

Program and Enrollment

Benchmark Hardscapes Estimate Alerts is a recurring, non-marketing program operated by Benchmark Hardscapes LLC for its business owner. Alerts identify new estimate requests; the owner may also request test notifications. The owner signs in to the private dashboard, opens Text notifications, actively selects the consent checkbox, which is unchecked by default, and clicks “Save notification settings.” The site records a consent timestamp before enabling alerts.

Consent is voluntary and is not a condition of purchasing goods or services. Submitting the public estimate form does not enroll a visitor in SMS messages. See our SMS consent information and screenshot.

Frequency, Charges, and Delivery

Frequency varies with estimate submissions, up to 20 estimate alerts per day, plus owner-requested test messages. Message and data rates may apply. Delivery depends on carrier availability and is not guaranteed. Carriers are not liable for delayed or undelivered messages.

Opt-Out and Help

Reply STOP to unsubscribe. Reply HELP for help. For assistance, email info@benchmarkhardscapes.com. Our Privacy Policy explains how we handle mobile information and SMS consent.

Changes to These Terms

We may update these Terms and will post the revised version here with an updated date. We will provide additional notice where required by law. Continued website use after an update takes effect is subject to the updated Terms. Website updates do not change an existing signed project agreement.
